High court orders UK government to explain clean air plan delay

The government has been ordered back to the high court to explain its last-minute bid to delay publication of the UK’s clean air plan.


Politicians and environmental groups had complained that ministers were “hiding behind the election” after they said they could not publish the proposals because of election purdah.


The high court said on Tuesday that there would be a new hearing on Thursday where ministers will have to defend their application.


James Thornton, CEO of the environmental lawyers ClientEarth, who brought the original case against the government, said they would present their response at the hearing on Thursday.


“This is a public health issue and not a political issue. Urgent action is required to protect people’s health from the illegal and poisonous air that we are forced to breathe in the UK.


“This is a matter for the court to decide once the government has made its arguments because it is the government which has not met, and instead seeks to extend, the court’s deadline for the clean air plan, to clean up our air.”


Ministers had been under a court direction to produce tougher draft measures to tackle illegal levels of nitrogen dioxide pollution, which is largely caused by diesel traffic, by 4pm on Monday. The original plans had been dismissed by judges as so poor as to be unlawful.

Last week figures obtained by Labour showed that more than 38 million people, representing 59.3% of the UK population, were living in areas where levels of nitrogen dioxide pollution were above legal limits.


Research consistently shows that exposure to traffic fumes is harmful to children and adults. Children are more vulnerable because their lungs are still developing and exposure to nitrogen dioxide reduces lung growth, causes long-term ill health and can result in premature death.

James Thornton, the group’s CEO, said: “The unacceptable last-minute nature of the government’s application late on Friday night, after the court had closed, has meant that we have spent the weekend considering our response.


“We are still examining our next steps. This is a question of public health and not of politics and for that reason we believe that the plans should be put in place without delay.”


The government lodged the lengthy application shortly before 7pm on Friday, which was too late for the court to accept. It was due to be considered by the court on Monday.


But ClientEarth said it was unlikely there would be a hearing on Monday as they would need time to respond to the government’s arguments, although the judge could order an emergency session.

The Stewards’ case has emerged after weeks of troubling news for the government on NHS capacity issues. Leaked figures showed that January was the worst months for A&E delays on record. And last week, a coroner said the bed shortages in intensive care had led to the death of Mary Muldowney, who was refused surgery at three hospitals last year because of a lack of space.


Dr Mark Porter, who chairs the British Medical Association, said the “shocking” case of Malcolm Steward was further evidence that patients were “repeatedly and unfairly being let down by an overstretched system”. Porter added that delays for vulnerable patients were now the norm.


“The NHS is at breaking point and unfortunately demand is so great that in many hospitals there is simply no capacity left in the system,” he said. “When the appropriate care isn’t available in the right setting, patients can experience delays. This can affect the quality of the care they receive, and in this instance have a profound effect on the patient and their family’s experience of the NHS.”

Dr Gary Masterson, president of the Intensive Care Society, said: “It is difficult to comment on this case specifically but in general terms a delay of several months resulting purely from critical care bed shortages is clearly unacceptable.”


Steward was left brain-damaged after having a stroke while driving in 2015. The crash left him with multiple injuries and he spent more than a year in hospital – moving between Southampton and Guildford.


Last month he was moved to a rehabilitation unit in Salisbury, but in the meantime his wife moved to Devon, where the couple had planned to relocate to before the accident. She found a local home that would take him and the move was set for last November. When this failed to happen, she was told that Torquay hospital, which backs up the care home, had blocked the move.

A letter from the hospital’s chief operating officer, sent at the end of October, said: “Torbay hospital has a small unit and if we are to accept people who may need long-term care we will significantly limit our ability to meet the needs of our local population.” It added that the hospital, which is south Devon’s main one, was to open in the spring and would be willing to accept a further referral then.


It currently has a nine-bed intensive care unit, which is almost 30 years old. The hospital has said that when the new unit opens in the spring it will add one new bed and then a further four over the next two years.


The hospital is concerned Malcolm Steward may need long-term care in one of their private rooms because of the complexity of his needs, limiting their ability to serve the local population. Doctors, however, said having long-stay patients was not unusual.


Philippa Steward travels four hours once a week to see her husband, which she says is affecting her health. After his accident she does not like driving at night but has no other option.


“I get no sleep because I am so worried about him,” she said. “If Torbay hospital don’t change their mind soon I fear I will lose my care home bed in Devon. There’s only one space available, which they may have to give to someone else. Another one might not come up in Malcolm’s lifetime.”


While her husband is unable to talk, he knows that she is there during these visits, she said. “He smiles and holds his hand out to me when I visit. He tries to give me a hug. He writes messages to me saying, ‘I want to come home and be with you.’”

Kevin Foster, the Conservative MP for Torbay, agreed the case had taken too long to resolve. “Although the case is with the [health service] ombudsman, I am still seeking a meeting with our local NHS to work out a quicker way to bring this matter to a satisfactory conclusion, which means bringing Malcolm nearer to his family here in the bay,” he said.


A spokesman for Torbay and South Devon NHS foundation trust said it could not comment on individual patients, but that its top priority in accepting a patient from another hospital “would be to ensure that we are able to put in place a safe pathway of care appropriate to that individual patient’s clinical needs”.


The spokesman added: “We regularly liaise with [the care home] Douglas House to ensure that any patient being transferred there has plans in place to ensure their safe care and treatment. We would never refuse a patient treatment in an emergency.”


The Stewards’ case will add further pressure on the government to address NHS bed shortages. In January Hull and East Yorkshire Hospitals NHS trust ran out of intensive care beds at its two hospitals and was struggling to provide normal care to the many patients needing treatment for life threatening conditions. Senior doctors told the Guardian that intensive care units were becoming so full that patient safety was increasingly at risk because life-saving operations were having to be delayed.


The BMA’s Mark Porter said: “We urgently need the government to look at the long-term funding, capacity and recruitment issues facing the system as a whole if we are to get to grips with the extreme pressure hospitals are now facing.”

The 2020 deadline faces fierce resistance from the oil and gas industry association, IPIECA, and Bimco, a global shipping group, which argue that there is not enough low-sulphur fuel available to meet the global demand that the measure would spur.


The EU has thrown its weight behind 2020, unilaterally imposing the new IMO standard from then. With China enforcing similar emissions control zones, the new benchmark for 2020 is thought likely to pass, although the US and large flag states’ positions remain wildcards.


James Corbett, one of the report’s lead authors, told the Guardian that any slippage on the 2020 start date risked grave consequences.


“An IMO policy implemented on time in 2020 could reduce the health burden on coastal communities, particularly in Asia, Africa and Latin America,” he said. “The inverse is also true. A delay would ensure that health impacts from sulphur emissions persisted in coastal communities that are exposed, where shipping lanes are most intense and communities most densely populated.”


Egypt, Panama, Japan, India, Singapore, the Philippines and China would be among the countries hardest hit, Corbett added.


Sveinung Oftedal, Norway’s lead negotiator at the IMO, said that domestic health concerns had now overtaken fears about the acidifying effects that sulphur has on Scandinavia’s lakes and rivers.


“Air pollution from shipping is not just a local or regional, but a global, problem,” he said. “The question is whether we can really continue to accept its effects, and the answer is: no, we cannot. The 2020 deadline is needed and it is achievable.”


But resentment in the beleaguered shipping trade is unmistakeable, and a sign of future fights to come in the IMO over shipping’s CO2 emissions, which roughly equal those from aviation.


“Most shipping companies are not turkeys voting for Christmas,” an industry source said. “They’re under the impression that a decision to delay to 2025 would be of collective economic benefit. In the real world, shipowners are bleeding money. There is total depression in the industry.”


Thousands of container ships belonging to Hanjin, south Korea’s biggest shipping firm, were left adrift on the world’s oceans carrying a £14bn cargo, after the firm filed for bancruptcy last month.


The International Chambers of Shipping (ICS) says that imposing the new benchmark in 2020 would cost industry an additional $ 50-100bn a year, owing to the cost of low-sulphur fuels.


Ships today mostly run on cheap blends of the residues and remainders left over from the refining and distillation of crude oil for aircraft jet fuel and automobile diesel.


Bimco argues that a premature move to low-sulphur fuels could have knock-on inflationary effects for other fuels, as increased diesel demand overwhelms supply.


Lars Robert Pedersen, Bimco’s deputy secretary-general, told the Guardian: “Quite frankly, if the IMO decides to ignore these very concrete facts, ships will start to use other fuel streams and there will then obviously be a shortage in those streams and a potential disruption in the flow of energy to supply world markets.”


Corbett estimates the total cost of the measure at $ 30bn, compared to a value of seaborne trade approaching $ 5tn in the South China Sea alone. Supporters of an early sulphur cap say that its effect on commodity prices such as shoes or bananas would be little more than a few cents.


Crucially, a second IMO report seen by the Guardian finds that enough refineries will be available in 2020 to guarantee the future availability of a low-sulphur fuel supply for all the world’s ships.


“In all scenarios, the refinery sector has the capability to supply sufficient quantities of marine fuels with a sulphur content of 0.5% m/m or less … to meet demand for these products, while also meeting demand for non-marine fuels,” it says.


A capacity shortage in 2020 would be the only grounds for IMO delegates to delay the proposal, under its terms of reference, which some fear could then be extended indefinitely.


In a reflection of differing opinions in the sea freight trade, the ICS is neutral on the timeline for phasing out sulphur, while calling for a speedy resolution of the issue.


The oil industry too is ambivalent. One analyst with close knowledge of the issue said: “Major oil companies such as Shell and BP don’t have a problem with a move to cleaner fuel in the shipping sector because they have advanced refineries which could sell higher value fuels and increase their revenues and potentially, their profits.”


Later this month, a global CO2 data collection system for ships will be launched. Neither shipping nor aviation firms are covered by the Paris climate agreement, although the ICS has called for the UN’s climate pledging system to be extended to the industry.
