You wouldn’t believe a business that has battled the Federal Trade Commission above its deceptive claims would strike a victory against misleading advertising.

But that’s specifically what occurred at the Supreme Court these days when POM Great triumphed above Coca-Cola Coca-Cola. You can read the ruling here, or this summary by the Associated Press.

The Supreme Court on Thursday sided with juice maker Pom Superb in its prolonged-working false advertising dispute with Coca Cola, a determination that could open the door to much more litigation towards meals makers for deceptive labeling.

The justices ruled eight- that Pom can go forward with a lawsuit alleging the label on a “Pomegranate Blueberry” beverage offered by Coke’s Minute Maid unit is misleading since 99 % of the drink consists of apple and grape juice.

POM’s business model, of course, is wildly more than-inflating the wellness benefits of pomegranate juice. That conflicts with Coca-Cola’s business model of marketing a mixture of apple and grape juice as if it had been pomegranate juice. Obviously, POM had to sue.

Four years ago, I looked into each POM and Coke’s VitaminWater brand for a Forbes function on how organizations were using often bogus wellness claims and additives to promote packaged meals as wholesome. At that time, POM was citing all varieties of benefits and touting its clinical science. The greatest review it had carried out to date was one that failed to show any benefit for the juice in cardiovascular condition. VitaminWater runs up against a complete lot of analysis that shows additional vitamins are at best ineffective.  Yet VitaminWater has run adverts joking that it’s greater than a flu shot.

POM has a point: offering what is largely grape juice as pomegranate juice is deceptive. Will this be very good for consumers?
