"Do not resuscitate" recognize was breach of human rights, judges rule

Addenbrooke’s Hospital claimed it had been acting in Mrs Tracey’s ideal interests.


The Government and health chiefs were accused in court of failing to tackle widespread confusion and uncertainty more than the imposition of notices on significantly ill individuals.


Lord Dyson, Master of the Rolls, who sat with Lord Justice Longmore and Lord Justice Ryder, declared that Cambridge University Hospitals (CUH) Trust had “violated Mrs Tracey’s Write-up eight appropriate (under the European Convention of Human Rights) to respect for private lifestyle in failing to involve her in the procedure which first led to the observe”.


But the judges rejected complaints that the Government had infringed her rights in her final days by failing to promulgate nationwide advice on DNR notices.


Following the ruling, a CUH spokesman stated: “The Believe in is considering the implications of this judgement and the subsequent actions very very carefully.


“The Trust is pleased that the court recognised the work that CUH has undertaken in implementing the Universal Form of Remedy Choices (UFTO).


“Developed and evaluated with patients, nurses and clinicians, UFTO is a new method to documenting cardiopulmonary resuscitation (CPR) and other therapy decisions. It was introduced across the Trust at the finish of April this year.”


Dr Keith McNeil, chief executive of CUH, extra: “Today’s ruling hinges on a particular stage of law. There was no criticism of our clinical care.


“It is a truth of daily life that each day folks die in hospitals. From my very own encounter as a specialist hospital physician, the most critical factor is that these individuals are handled with the utmost respect and dignity.


“End of lifestyle scenarios involve medical doctors and nurses possessing emotionally tough but essential conversations, with patients and their households about what transpires in the last stages of their care.


“Health care employees use a combination of their compassion, experience and judgement at these difficult occasions, to attempt and find the correct pathway for every person patient, and offer the assistance required for everyone involved.”
